“Supreme Court Green-lights ‘Creamy Layer’ Check in SC/ST Quotas — Hearing Slated for Oct 10!”


The Supreme Court of India has accepted a public interest litigation seeking to apply a “creamy layer” criterion to SC/ST reservations, akin to the system used for OBCs, in order to ensure reservation benefits primarily reach the poorest among SC/ST communities, rather than the relatively affluent. The petition, filed by Ramashankar Prajapati, argues that current reservation policies disproportionately favor well-off and influential SC/ST individuals, leaving the most economically disadvantaged behind. A bench led by Justices Surya Kant and Joymalya Bagchi has issued a notice to the central government and scheduled the next hearing for 10 October 2025. The petitioner referenced the Supreme Court’s August 2024 judgment in State of Punjab v. Davinder Singh, which endorsed the idea that SC/ST communities can have sub‑classifications and that a “creamy layer” exclusion could be developed to preserve the spirit of affirmative action.
